Modalidad (a)(3) — Offensive/provocative contact

- Bodily injury threat. The threat must be of bodily injury, not just unwanted contact. "I will spit on you" is not threat of bodily injury; "I will hit you" is.
- Mens rea — intentional or knowing. Imprudence does not qualify. The acusado must have intended to threaten or known that the conduct would be perceived as threat.
- Perception by victim. Although the statute speaks of "threaten," courts have interpreted to require that la victima actually perceived the threat. Garcia v. State, 367 S.W.3d 683 (Tex. Crim. App. 2012).
Defenses to threat assault include: (a) ambiguity of statement — if the alleged threat could reasonably be interpreted as joke, venting, or non-threat, reasonable doubt exists; (b) lack of imminence — threats of future harm don't qualify; (c) lack of perception — if la victima did not perceive threat (e.g., didn't hear it, didn't take it seriously), elemento falta; (d) self-defense bajo Capitulo 9 — threats made en respuesta to unlawful aggression may be justified.
Offensive contact assault bajo seccion 22.01(a)(3)

- Knew or should reasonably know offensive/provocative. The acusado must have known or reasonably should have known that the contact would be regarded as offensive or provocative. This is judged from the perspective of a reasonable person en the circumstances.
The Class C grade is significant. Class C convictions: (a) carry no jail time, only fine up to $500; (b) are sealable mas easily under Government Code Capitulo 411 after expiration of limitations periods; (c) do NOT trigger federal firearms prohibition under 18 U.S.C. 922(g)(9) generally (with exceptions for "misdemeanor crime of domestic violence" definitions); (d) have lesser immigration consequences typically.
For these reasons, negotiating a Class A assault-BI charge down to a Class C offensive contact charge es one of the most valuable plea outcomes. The conduct alleged frequently fits both modalidades — la victima's testimony of pain (sustaining (a)(1)) is necessary but not always provable beyond reasonable doubt, while testimony that contact occurred y was offensive (sustaining (a)(3)) is often easier to prove. Self-defense bajo Penal Code Capitulo 9
Self-defense es la defensa primaria en assault cases. Penal Code Capitulo 9 (Justification Excluding Criminal Responsibility) contains the relevant statutes:
- seccion 9.31 (self-defense, non-deadly force). Mutual combat bajo seccion 22.06 — consent as defense
Penal Code seccion 22.06 establece consent como defense to assault si the conduct did not threaten or inflict serious bodily injury, y the victim knew the conduct was a risk of: (1) la victima's occupation; (2) recognized medical treatment; or (3) a scientific experiment conducted by recognized methods.
Mutual combat application:
- Bar fights y schoolyard altercations. When two parties mutually agree to fight, the consent defense may apply if the fight does not result en serious bodily injury. Both parties facing assault charges can invoke mutual combat.
- Organized sports y boxing. Participants in organized boxing, MMA, football, hockey, etc. impliedly consent to physical contact within the rules of the sport. People v. Carbajal, 56 Cal. 4th 521 (2013), addresses sports context.
- Limited to non-serious injuries. Once serious bodily injury occurs, consent no longer is defense. This means a bar fight that begins as mutual combat can escalate to criminal liability if one party sustains SBI.
- Affirmative defense burden. Like self-defense, consent is affirmative defense — acusado must produce evidence; Estado must disprove beyond reasonable doubt.
Mutual combat is frequently overlooked but can be powerful in cases involving voluntary altercations. The defense investigates whether la victima initiated, escalated, willingly participated, or made statements indicating willingness to fight. Social media, witness statements, body cam footage often capture relevant evidence.
Pretrial diversions, deferred adjudication, y plea options
For most assault cases, especially first-time misdemeanors, multiple resolution paths exist short of trial conviction:
- Outright dismissal. If evidence sufficiency is weak, if la victima recants or refuses to cooperate, if self-defense is clearly established, prosecutor may dismiss. Defense advocacy plays significant role en encouraging dismissal.
- Pretrial diversion. Many counties offer pretrial diversion programs for first-time misdemeanor assaults. - Class C reduction. Negotiating Class A (a)(1) charge down to Class C (a)(3) offensive contact charge. Eliminates jail exposure, allows easier sealing, reduces collateral consequences.
- Conviction with probation. If conviction occurs, community supervision (probation) is often available in lieu of jail. Terms vary by case but typically include reporting, counseling, no contact with la victima, restitution.
- Outright conviction with sentence. Trial conviction or plea with sentence. For Class A misdemeanors, sentence may be up to 1 year jail. For felonies, prison time.
For family violence cases, negotiating absence of family violence finding bajo CCP Art. 42.013 is central. The judge has discretion to enter family violence finding even on deferred adjudication that ultimately dismisses, but skillful negotiation can sometimes obtain finding-free disposition.
