Two of the court’s published positions matter more than any advice a stranger gives you online. First, the court’s own guidance states that a person with an outstanding warrant who appears and makes a good faith effort to resolve the case will not be arrested. Second, for a Class C case a cash bond can be posted either in person at the Municipal Court, where the amount of the citation is the amount of the cash bond, or processed at the jail where the defendant is being held, and the court does not accept checks, credit cards or money orders for cash bonds. Bring actual cash or the trip fails.
What we defend here
Driving while intoxicated. Texas Penal Code Section 49.04 reaches operating a motor vehicle in a public place while intoxicated. Section 49.09 raises a second offense to a Class A misdemeanor and a third to a third-degree felony. Denton County is one of the counties that runs a dedicated DWI Treatment Court for select repeat offenders, which makes the second and third case here strategically different from a first.
Marijuana and controlled substances. Possession of marijuana under Health and Safety Code Section 481.121 is a Class B misdemeanor under two ounces and a Class A between two and four. Penalty Group 1 possession runs through Section 481.115, where under a gram is a state jail felony. Denton County’s First Offender Drug Program exists precisely for the low-risk first-time end of this, so the charge and the criminal history get evaluated together, not separately.
Theft and organized retail theft. Penal Code Section 31.03 grades ordinary theft by the value of what was taken. Section 31.16 is the one people do not see coming: organized retail theft covers conduct in concert with others to conduct, promote or facilitate activity involving stolen retail merchandise, and it carries its own value ladder. A group accusation can therefore sit a full level above what any single person allegedly carried out the door.
Assault. Penal Code Section 22.01 covers three different things people call the same word. Assault by threat and assault by offensive or provocative contact are Class C offenses that can stay in the municipal court. Assault causing bodily injury is a Class A misdemeanor that leaves the city and goes to a county court. Where the complainant is a family or household member, the case carries family violence consequences that outlast the sentence, including firearm restrictions.
