Penal Code seccion 22.012 — elementos del delito

10-anos sex offender registration bajo CCP Art. 62.001(5)(A)
CCP Art. 62.001(5)(A) categoriza una condena por seccion 22.012 (indecent assault) como reportable conviction que activa sex offender registration. Mens rea defense — "intent to arouse or gratify sexual desire"

- Privacy y secrecy. Touching in secluded location, request to keep secret, attempts to avoid witnesses all suggest awareness that conduct was inappropriate.
- Pattern. Multiple victims or repeat incidents may be admitted bajo Rule 404(b) to prove intent (con limiting instruction).

Consent defense y challenges to "without consent" element

- Mistaken belief in consent. Mistake of fact bajo Penal Code seccion 8.02(a) — if the defendant reasonably but mistakenly believed the victim consented.
- Lack of evidence of non-consent. The prosecution must affirmatively prove lack of consent. If the victim did not refuse, did not pull away, did not verbally object, did not appear distressed during o immediately after the contact — these all support reasonable doubt about non-consent.
El timing of victim disclosure may be relevant — immediate outcry suggests genuine non-consent; delayed disclosure (weeks, months, years later) may indicate fabrication, mistake, regret, o external motivation (custody dispute, civil lawsuit, immigration matter, child support). Cross-examination debe explore the timeline of disclosure carefully.
Bajo Texas Rule of Evidence 412 (rape shield), evidence of the victim past sexual conduct is generally inadmissible except for specific exceptions. Pero excepcion bajo Rule 412(b)(2)(B) for past sexual conduct between the victim and the accused is relevant in indecent assault cases — past consensual contact between the parties may support reasonable belief of consent and may be admissible. - Texas Rule of Evidence 403 balancing. Graphic detail, character evidence, prior bad acts may be excluded where probative value is substantially outweighed by unfair prejudice.
- Texas Rule of Evidence 404(b). Prior bad acts may not be admitted to show character or propensity, only for specific permissible purposes (motive, intent, plan, identity, absence of mistake). Strict limiting instructions required.
- Pretrial publicity. En high-profile cases, pretrial publicity may require change of venue motion bajo CCP Art. 31.03 o expanded voir dire bajo CCP Art. 35.17.

- Officer interview tactics. Was the defendant Mirandized? Were any statements obtained voluntarily, sin coercion? Bajo Miranda v. Arizona, 384 U.S. 436 (1966), statements obtained without proper warnings o waivers are inadmissible.
- Suggestive identification. If the victim identified the defendant via photo lineup, in-person show-up, o other procedure, the identification may be suggestively obtained y subject to challenge bajo Manson v. Brathwaite, 432 U.S. 98 (1977).
- Search of devices. If the investigation searched defendant phone, computer, social media, the warrants must satisfy Riley v. California, 573 U.S. 373 (2014).

- Education. Universities frequently have grounds for discipline o expulsion based on sex offender status. Athletic scholarships may be revoked.
- Housing. Apartment complexes frequently deny rental to registered sex offenders. Federal subsidized housing prohibits lifetime registrants bajo 42 U.S.C. seccion 1437n(c) (but indecent assault is 10-year not lifetime, so this may not bar).
- Inmigracion. Crime involving moral turpitude potentially affects non-citizens. Mathis v. United States, 579 U.S. 500 (2016), categorical approach. Bajo Padilla v. Kentucky, consejo competente sobre estas consecuencias es required.
- Family law. May affect custody, visitation orders, particularly with minor children. Texas Family Code seccion 153.004(d).
