  • Mere opportunity is not entrapment. Responding to defendant initiated contact, posting available service ad, accepting defendant offer — these provide opportunity but are not entrapment.
  • Officer-driven escalation. If officer introduced sexual elements that defendant did not raise, pushed for specific acts defendant initially declined, these support entrapment.

Critical evidence:

  • Recordings of all conversations (frequently officers wear body cams or audio recorders);
  • Complete text/email exchanges before meeting;
  • Officer report y notes;
  • Identity y training of officer;
  • Pattern of officer prior operations.

Mens rea challenges also valuable:

  • "Knowingly" requirement. Defendant must have known the conduct involved sexual conduct for fee. Mere acceptance of "tip" o "gratuity" without explicit agreement for sexual conduct may not satisfy the statute.
  • "Sexual conduct" specificity. The agreement must specify sexual conduct as defined in seccion 43.01(4). General "company" o "companionship" agreements without specific sexual conduct may not satisfy.
  • "Fee" specificity. Specific monetary amount typically required. Vague reference to compensation may not satisfy.

Pretrial diversion y plea negotiation options

Class B misdemeanor prostitution (first offense) is eligible for multiple alternative dispositions:

  • Pretrial diversion. Some counties have prostitution-specific diversion programs (Dallas County PEACE Initiative, Houston SAFE Court).   • Disputing the prior convictions (validity, identity, finality);
  • Sealing eligible prior convictions to prevent enhancement;
  • Negotiating to misdemeanor charge with state jail felony enhancement avoidance;

  • 18 U.S.C. seccion 1952. Travel Act — travel in interstate commerce to promote unlawful activity. Penalty: up to 5 years (managing); up to 20 years (acts of violence).

Federal interest typically arises when:

  • Operation involves interstate travel o communication;
  • Multiple defendants across state lines;
  • Organized prostitution enterprise;
  • Trafficking involving force, fraud, coercion, or minor;
  • Federal task force involvement (FBI, ICE, HSI).

Federal sentencing under U.S. Sentencing Guidelines seccion 2G1.3 (transportation of minors) y 2G1.5 (offenses involving forced labor) calculate offense level based on specific offense conduct.
