- Conversation escalates. The conversation progresses toward sexually explicit topics. The officer may introduce sexual topics o respond to defendant introduction. Photos, sexual language, descriptions of acts.
- Meeting arrangement. The officer suggests or defendant suggests in-person meeting. Specifics arranged — location, time, what to bring. The defendant may travel to the meeting location.
- Arrest. Officers arrest the defendant either upon arrival at meeting location, or at home/work after the chat conversation if no meeting was arranged. Search warrant for devices.
The chat logs are typically the central evidence. Defense must obtain complete chat logs, not just selected excerpts — frequently the prosecution case rests on portions while omitting context that supports defense. Demand:
- Complete chat logs from initial contact through final communication;
- Officer notes y reports of the operation;
- Identity y training of the undercover officer;
- Other operations by the same officer (pattern of tactics);
- Recordings of any phone calls;
- Photos exchanged in both directions;
- Officer scripts o talking points provided by training.
The chat log analysis frequently reveals officer-driven escalation:
- Officer introduces sexual topics first;
- Officer initiates suggestions of meeting;
- Officer persists despite defendant hesitation o withdrawal;
- Officer specifies graphic details that defendant merely acknowledges;
- Officer ignores defendant statements indicating lack of intent to actually meet.
Each of these supports the entrapment defense (next section). The complete chat logs may reveal a much different picture than the prosecution's selected excerpts.
Entrapment defense bajo Penal Code seccion 8.06
Penal Code seccion 8.06 establece la defensa afirmativa de entrapment: "It is a defense to prosecution that the actor engaged in the conduct charged because he was induced to do so by a law enforcement agent using persuasion or other means likely to cause persons to commit the offense. Conduct merely affording a person an opportunity to commit an offense does not constitute entrapment."

- Government conduct sufficient to induce normally law-abiding person. Was the police inducement strong enough that a person not predisposed to commit the offense would have done so under similar circumstances? This is an objective analysis focused on the conduct, not the defendant.
- Mere opportunity is not entrapment. Providing an opportunity to commit an offense (responding to defendant initiated conversation, posing as available partner) is permissible. The line is between opportunity and inducement.
- Inducement factors. Persistent persuasion after rejection, appeals to sympathy, exploitation of addiction o financial need, dramatic escalation by officer, unusual incentives — these all support inducement claim.
The standard for Texas is more defense-favorable than the federal standard. Federal courts use a subjective test (United States v. Russell, 411 U.S. 423 (1973)) focusing on defendant predisposition. The Texas objective standard focuses on government conduct regardless of defendant history.
The entrapment defense is affirmative — defendant bears the burden of production by a preponderance. Once raised, the prosecution must disprove beyond reasonable doubt. The jury receives instruction on entrapment if the defense is raised by evidence.
The chat logs are the central evidence for entrapment analysis. The complete record may reveal:
- Officer-initiated contact and persistent follow-up despite defendant hesitation;
- Officer-introduced sexual topics that defendant did not raise;
- Officer-driven meeting arrangement that defendant tried to decline;
- Officer exploitation of defendant emotional vulnerability or social isolation;
- Officer-supplied details of unlawful conduct that defendant did not previously have in mind;
- Multiple unsuccessful efforts by officer before defendant engaged.
However, entrapment defense is difficult to win at trial. Juries often respond to the underlying conduct (sexual communication with apparent minor) regardless of officer tactics. The defense is more effective in pretrial negotiation to reduce charges or obtain favorable plea.
Affirmative defenses bajo seccion 33.021(d)
Penal Code seccion 33.021(d) provee defensas afirmativas a prosecution bajo este statute:
- Subseccion (d)(1). The actor at the time of the conduct: (A) was the spouse of the menor; o (B) was no more than three years older than the menor, the menor consented to the conduct, and the actor used no compulsion to obtain the consent.
- Subseccion (d)(2). The actor employed a reasonable belief based on the menor representations that the menor was at least 17 years of age. La burden de production recae en el acusado.

- Conversational sophistication. Adult conversation style, vocabulary, cultural references all support reasonable belief de adult.
- Age claim by officer. If officer inconsistently claimed adult age o avoided clear age statement, the defendant may have ambiguous understanding.
- Time of day y context. Conversation during normal adult hours on adult-oriented platforms supports reasonable belief.
The defense fails when the officer made clear age statement that should have been credited by reasonable person:
- Officer states "I am 14" early in conversation;
- Officer references school grade level;
- Officer mentions parents and curfew;
- Officer profile clearly indicates minor age;
- Defendant explicitly acknowledges minor age in response.
Even when the defense fails, mens rea challenges may reduce the charge from second-degree (menor de 14 or belief thereof) to third-degree (menor 14-17). Each graduated reduction has significant sentencing implications.
Constitutional challenges — Ex parte Lo y First Amendment
Penal Code seccion 33.021 has been subject to multiple constitutional challenges. Ex parte Lo, 424 S.W.3d 10 (Tex. Crim. App. 2013), invalidated a prior version of subseccion (b) as facially unconstitutional under the First Amendment for criminalizing protected speech without narrow tailoring.
The Lo court found the statute was content-based restriction on speech and could not satisfy strict scrutiny because: (1) it criminalized speech that did not create clear and present danger; (2) it captured a wide range of protected expression; (3) less restrictive alternatives existed. The legislature responded by amending the statute to narrow its scope and add intent requirements.
The amended version (post-Lo) requires: (1) sexually explicit communication specifically; (2) communication "in a sexually explicit manner" requiring more than incidental sexual content; (3) intent that the content reach a menor; (4) defendant knowledge of menor status. These elements narrow the statute to address Lo concerns.
Pero constitutional challenges remain available:
- Overbreadth as-applied. In specific cases where the communication relates to protected expression (sex education, public health, artistic context), the statute application may exceed constitutional limits.
- Vagueness. "Sexually explicit manner" and other terms may be vague as applied. Defendant lacks fair notice of prohibited conduct.
- Sting tactics constituting outrageous conduct. Bajo United States v. Russell, 411 U.S. 423 (1973), outrageous government conduct may violate due process. Texas Court of Criminal Appeals has recognized this as separate from entrapment in some cases.
- Equal protection. If enforcement is discriminatory (targeting particular demographic groups disproportionately), equal protection challenge may be available.
Federal challenges may also be available bajo 42 U.S.C. seccion 1983 civil rights action after criminal proceeding concludes. But the practical effect on the criminal defense is limited — the focus must be on the criminal case itself.
Fourth Amendment y la legalidad de la digital search
Online solicitation cases inevitably involve digital search of devices — phones, computers, tablets, social media accounts, ISP records. Riley v. California, 573 U.S. 373 (2014), requires warrant for examen forense de cellular phone. Cuestiones especificas:

- Plain view doctrine limitations. Even within authorized search, plain view discovery of unrelated evidence may exceed scope. Each unauthorized expansion is subject to challenge.
- Cloud accounts. Acceso a Facebook, Instagram, Snapchat, Gmail requires separate warrant bajo 18 U.S.C. seccion 2703 (Stored Communications Act).
- ISP records. Subscriber identification, IP logs require warrant bajo SCA. Carpenter v. United States, 138 S. Ct. 2206 (2018), applies similar logic to extensive ISP data collection.
- Pen register / trap and trace. If used to identify defendant, pen register requires court order bajo 18 U.S.C. seccion 3122. Substantive challenges are limited but procedural compliance must be verified.
Texas CCP Art. 38.23 exclusionary rule is more protective than federal — Texas does not recognize good-faith exception in many circumstances. Cualquier evidence obtained through illegal search may be suppressed bajo Article 38.23, frequently resulting in dismissal of the entire case.
The defense should obtain complete copies of all warrants, affidavits, returns, and inventory. Analyze each for sufficiency, particularity, scope, and execution. Move to suppress aggressively wherever defects exist.

- Computer/internet restrictions. Community supervision conditions bajo CCP Art. 42A.515 frequently include internet restrictions, computer monitoring software, no unsupervised access to minors.
- Civil exposure. Parallel civil lawsuit possible by alleged victim families.
