Multiple tipos de warrants pueden activarse, cada uno con bases legales distintas y procedures de recall distintos:

Recall vs surrender vs arrest — las opciones
Hay tres caminos para resolver warrant activo:
1. Recall (lift) the warrant. Si circumstances justify, court puede recall (cancel) the warrant before any arrest. Esto require:

- Magistrate must conduct hearing within 48 hours of application (72 hours if weekend).

Recall is more likely successful in some scenarios than others:
Recall more likely when:
- Warrant issued in error. Mistake in identification, duplicate warrant after underlying case resolved, warrant remained active after circumstances changed.
- Failure to appear with valid excuse. Medical emergency, military deployment, miscommunication about court date. With documentation, court may recall warrant.
- Defendant has resolved underlying issue. Paid restitution, completed required class, addressed compliance issue.
- Capias pro fine cases. Often easily resolved through payment plan or community service arrangements.
- Probation violations with mitigating circumstances. When defendant can show compliance attempt or extenuating circumstances.
Recall less likely when:
- Felony charges. Courts reluctant to recall felony arrest warrants without strong justification.
- Multiple failures to appear. Pattern of non-compliance reduces court willingness.
- Recent serious violations. If warrant relates to recent violations of community supervision or recent criminal conduct, recall is rare.
- Violent offense charges. Public safety concerns weigh against recall.
When recall is not realistic, surrender is preferred over waiting for arrest. Surrender allows:
- Coordinated timing (after work, weekend, with family arrangements made).
- Bond pre-arrangements (bondsman ready, funds available).
- Defense counsel present for booking and bond hearing.
- Avoid embarrassing or disruptive arrest in workplace o publico.
- Demonstrate good faith to court — favorable factor in bond hearing.

For Class C misdemeanors and minor warrants. Process may be expedited — defendant may simply appear at appropriate court, pay fine or post bond, and resolve immediately without booking.
Conducta to AVOID with active warrant

- Surrender on felony with bond hearing. Same as above but with higher bond expected y potentially more substantial conditions of release.
- No bond / held without bond. Most serious felony cargos (capital murder, certain habitual offenders) may result in no bond set. CCP Art. 17.291 hearing rights apply.
