  • Crack smoked: Inhaled vapor crosses the alveolar membrane in seconds; peak effect within 60-90 seconds; duration 10-15 minutes

The shorter, more intense crack experience produces stronger compulsive-use patterns. This pharmacology — not different molecular identity — explains the "crack epidemic" narrative of the 1980s-90s and the disparate sentencing that followed.

Texas charging: identical to powder

Texas Health & Safety Code §481.115 charges all cocaine (powder, crack, or freebase) by aggregate weight under the same Penalty Group 1 schedule:

Texas does not impose enhanced penalties for crack as a form. Federal law historically did — the Anti-Drug Abuse Act of 1986 created the 100:1 crack-powder disparity, treating 5 grams of crack the same as 500 grams of powder for mandatory-minimum purposes. The Fair Sentencing Act of 2010 reduced the disparity to 18:1; reform legislation continues to seek 1:1 parity. A federal case is therefore very different from a Texas state case for the same substance.

Why crack cases still differ in practice

Even with identical Texas charging, crack cases tend to present differently in three ways:

  1. Lower-quantity prosecutions: Crack is typically sold in smaller retail units ($5-$20 rocks), producing more arrests at the state-jail-felony tier (under 1 gram) and fewer at higher tiers.
  2. Paraphernalia overlap: Crack possession often comes with crack pipes — separate Class C paraphernalia charges, plus residue analysis that can elevate the pipe to a separate Penalty Group 1 charge.
  3. Distribution context: Crack retail tends to attract more concentrated law enforcement activity — corner sales, surveillance operations, controlled buys — producing more frequent delivery charges (§481.112) alongside possession.
