Are psilocybin mushrooms in Penalty Group 1-A?
No. Psilocybin (active compound in psychedelic mushrooms) is in Penalty Group 2 under HSC § 481.103 and is measured by weight, not dosage units. The dosage-unit system in Group 1-A applies specifically to LSD and structurally related compounds. Texas has not legalized psilocybin therapeutic use.
Can I be charged with possession if LSD is found on a friend's blotter sheet in my car?
Constructive possession under HSC § 481.115 and § 481.002(38) requires the State to prove care, custody, control, or management through "affirmative links" — proximity, knowledge of the substance's presence, access, defendant's statements.
