Texas expired registration — Transportation Code § 502.040
Texas expired registration is a criminal offense under Transportation Code § 502.040. Base conduct is classified as a Class C misdemeanor; enhancements, value tiers, or aggravators can move the classification up to felony exposure. Below: the controlling statute text, the full punishment range, common defense theories, and what to do if you have been charged in Collin, Dallas, Denton, or Tarrant County.
Classification: Class C misdemeanor
Punishment range: Class C misdemeanor — fine up to $200; doubled fines for habitual violators and surcharges for non-compliance after warning
The controlling statute
Texas Transportation Code § 502.040 requires the owner of a motor vehicle to register the vehicle annually with the county tax assessor-collector. Operation of an unregistered vehicle, or one with expired registration, is a Class C misdemeanor under § 502.473. The offense is one of the most commonly charged Texas traffic violations and frequently appears alongside no-insurance and equipment-violation charges. Beginning in 2015, Texas merged inspection and registration, so an expired registration also signals an expired safety inspection.

Elements the State must prove
To convict on a Texas § 502.040 charge, the State must prove every element beyond a reasonable doubt:
- Defendant owned or operated a motor vehicle subject to registration
- Vehicle's registration was expired or never obtained
- Vehicle was operated on a public highway
- Operation was intentional or knowing
Defense strategies
L and L Law Group, PLLC develops the following defense strategies on every Expired Registration case:
- Vehicle was registered before stop — DPS records lag or temporary plate issuance
- Vehicle was within the grace period after recent registration expiration
- Vehicle was not operated on a public highway under § 1.07(a)(40)
- Wrong vehicle identification or paper tag fraud
- Vehicle was exempt — antique vehicle, federal government, certain trailers
- Defendant was not the owner and reasonably believed the vehicle was registered
Enhancements & collateral consequences
Section 502.473 does not have built-in escalation, but repeated unregistered operation can support failure-to-display or attempted-fraud charges. Tampering with registration insignia under § 502.475 is a separate Class B misdemeanor. Failure to address the violation can lead to a hold on registration renewal and may trigger Failure to Appear warrants under Penal Code § 38.10.
